These Terms and
Conditions ('Terms') govern your access to and use of the NikkNok platform,
including the website, mobile application, smart TV application, and all
related services (collectively, the 'Platform'). By accessing or using NikkNok,
you agree to be legally bound by these Terms. If you do not agree to these
Terms, you must discontinue use of the Platform immediately.
5.1 Acceptance of Terms
These Terms
constitute a legally binding agreement between you ('User') and NikkNok
('Platform', 'We', 'Us', 'Our'). Use of the Platform signifies unconditional
acceptance of these Terms, our Privacy Policy, Refund Policy, Rent Policy, and
Copyright Policy.
5.2 Eligibility

Users must be at least
eighteen (18) years of age to register and use the Platform independently.

Minors between the ages of
thirteen (13) and eighteen (18) may use the Platform only with explicit
parental or guardian consent.

NikkNok reserves the right
to verify user age and identity and to terminate accounts found to be in
violation of eligibility requirements.
5.3 Account Registration

Users must create an
account to access NikkNok's full content library.
•
Users are responsible for
maintaining the confidentiality of their login credentials.

Each account is for
personal use only and may not be shared commercially.
•
NikkNok reserves the right
to suspend or terminate accounts where unauthorized or suspicious activity is
detected.

Users must provide
accurate, current, and complete information during registration and update the
same as necessary.
5.4 Subscription Plans & Access
NikkNok offers
various subscription plans that provide different levels of access to content.
The specific features, pricing, and terms of each plan are described on the
Platform. NikkNok reserves the right to modify, introduce, or discontinue
subscription plans at any time with reasonable prior notice.
5.5 License to Use
Subject to
compliance with these Terms, NikkNok grants you a limited, non-exclusive,
non-transferable, revocable license to access and view content on the Platform
for your personal, non-commercial use only. This license does not include any
right to resell, download (except as expressly permitted), distribute,
reproduce, perform, publicly display, or create derivative works from any
content on the Platform.
5.6 Prohibited Conduct
Users are
strictly prohibited from:

Sharing account credentials
with third parties for commercial purposes

Bypassing or circumventing
technical protection measures, DRM systems, or geo-restrictions
•
Recording, downloading, or
redistributing content without express written authorization
•
Using the Platform for any
unlawful, fraudulent, or malicious purpose
•
Uploading or transmitting
viruses, malware, or harmful code
•
Attempting to gain
unauthorized access to NikkNok's servers, databases, or systems
•
Engaging in any conduct
that disrupts the availability or functionality of the Platform
•
Impersonating NikkNok, its
employees, or any other user
5.7 Content on the Platform
NikkNok makes
no guarantee regarding the availability, completeness, or accuracy of any
content. Content availability may vary by region, subscription plan, or
licensing agreements. NikkNok reserves the right to add, modify, or remove
content at any time without prior notice.
5.8 Intellectual Property
All
intellectual property on the Platform, including but not limited to the NikkNok
brand, logo, software, designs, original content, and text, are the exclusive
property of NikkNok or its licensors. Unauthorized use constitutes a violation
of intellectual property law.
5.9 Limitation of Liability
To the fullest
extent permitted by applicable law, NikkNok shall not be liable for any
indirect, incidental, special, consequential, or punitive damages arising from
the use of or inability to use the Platform, even if NikkNok has been advised
of the possibility of such damages. NikkNok's total aggregate liability to any
user shall not exceed the total amount paid by the user for the specific
subscription or rental in dispute.
5.10 Disclaimer of Warranties
The NikkNok
Platform is provided on an 'as is' and 'as available' basis without warranties
of any kind, either express or implied, including but not limited to warranties
of merchantability, fitness for a particular purpose, uninterrupted access, or
error-free operation.
5.11 Governing Law & Jurisdiction
These Terms and
Conditions shall be governed by and construed in accordance with the laws of
India. Any disputes arising out of or in connection with these Terms shall be
subject to the exclusive jurisdiction of the competent courts of Ahmedabad,
Gujarat, India.
5.12 Amendments
NikkNok
reserves the right to modify these Terms at any time. Changes will be
communicated via the Platform and/or email. Continued use of the Platform
following any such changes constitutes acceptance of the revised Terms.
5.13 Termination
NikkNok
reserves the right to suspend or permanently terminate a user's access to the
Platform at any time, with or without notice, for violations of these Terms or
for any reason at NikkNok's sole discretion. Users may also terminate their
account at any time by contacting NikkNok's support team.
